Recently published in The Journal of Insurance & Indemnity Law, Sandra Lake's article discusses application of the commonly known "suit within a suit" doctrine as applied to claims of legal malpractice, when it applies, and the difference between having to show that a party would have prevailed but for attorney negligence and having to show them that party could have achieved a better outcome but for the alleged malpractice.
